This Privacy Policy explains how Jonathan Marbas Services LLC, doing business as Jonathan Marbas Fitness (“Company,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit our websites, use our apps, enroll in coaching/programs, or otherwise interact with us (collectively, the “Services”). We are based in Las Vegas, Nevada (Clark County).

By using the Services, you agree to the practices described here. If you do not agree, please do not use the Services.


1) Scope & Who We Are

This Policy applies to information we collect through:

  • Our websites, portals, and online communities,

  • Coaching/program sign-ups, assessments, challenges, and events,

  • Emails, texts/SMS, newsletters, and customer support,

  • Purchases and payment processing,

  • Any other Services that link to this Policy.

We are not a HIPAA-covered entity. Any health or wellness information you share with us is handled as personal information, not as “protected health information” under HIPAA.


2) Information We Collect

A. Information You Provide

  • Contact & account data: name, email, phone number, address, username/password.

  • Profile & coaching data: fitness history, goals, preferences, measurements, progress updates, photos/videos you choose to upload, and form responses.

  • Communications: messages, survey responses, support requests, testimonials, reviews.

  • Payment info: processed by our payment partners (e.g., Stripe)—we do not store full card numbers.

  • Referral program info: your referrals’ contact details (only when you submit them and as permitted by law).

B. Information Collected Automatically

  • Device/usage data: IP address, browser type, device identifiers, pages viewed, links clicked, session time, approximate location (derived from IP), and similar usage analytics.

  • Cookies & similar tech: pixels, SDKs, and local storage to enable features, remember settings, and analyze/ improve the Services. See Cookies & Tracking below.

C. Information from Third Parties

  • Platforms & tools we use to operate the Services (e.g., website hosts, analytics, email/SMS tools, learning/community platforms like Kajabi, ClickFunnels, Skool),

  • Social media or sign-in providers when you connect accounts,

  • Payment processors and fraud-prevention vendors.


3) How We Use Information

We use personal information to:

  • Provide, personalize, and improve the Services and your coaching experience,

  • Process transactions, subscriptions, and account management,

  • Communicate with you (service notices, coaching updates, marketing with your consent),

  • Operate communities, challenges, and events (including limited session recordings for quality and support),

  • Conduct analytics, research, troubleshooting, and security monitoring,

  • Comply with legal obligations and enforce our Terms & Conditions.


4) How We Share Information

We share personal information with:

  • Service providers/contractors who process data on our behalf (e.g., hosting, analytics, email/SMS, payments, customer support), bound by confidentiality obligations,

  • Program facilitators/coaches working with us under appropriate agreements,

  • Legal & safety recipients when required (court orders, to protect rights, prevent fraud/security incidents),

  • Business transfers (e.g., merger, acquisition, or reorganization).

We do not sell personal information for money. We may “share” data (as defined by certain U.S. state laws like the California Consumer Privacy Act/CPRA) for cross-context behavioral/targeted advertising. You can opt out—see Your Choices & Rights.


5) Cookies & Tracking

We use cookies and similar technologies to:

  • Keep you signed in and remember preferences,

  • Measure performance and understand usage,

  • Offer content and ads we believe may interest you.

Your choices: You can manage cookies via your browser settings. Some browsers also offer Global Privacy Control (GPC) signals; where required, we treat GPC as a request to opt out of targeted advertising/sharing. Disabling cookies may limit certain features.


6) Marketing Communications (Email/SMS)

If you provide contact info, we may send:

  • Service/transactional messages (e.g., receipts, coaching logistics),

  • Marketing messages (e.g., tips, offers) with your consent where required.

Opt-out: Click “unsubscribe” in emails or reply STOP to SMS. Message/data rates may apply. We may still send essential service notices where permitted.


7) Data Retention

We keep personal information as long as needed for the purposes described above, to provide the Services, to comply with legal obligations, resolve disputes, and enforce agreements. When no longer needed, we delete or de-identify it according to our retention practices.


8) Security

We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.


9) Children’s Privacy

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.


10) Your Choices & Rights

General (All Users)

  • Access/Update: Request access to or correction of your personal information.

  • Delete: Request deletion, subject to legal exceptions.

  • Opt out of marketing: Unsubscribe or reply STOP to SMS.

  • Opt out of targeted ads/“sharing”: See below.

Contact us at [email protected] (or the email in Contact Us) to make a request. We may ask for information to verify your identity. You can designate an authorized agent where state law allows (we may require proof and your direct verification).

California (CPRA) – If Applicable

California residents may have the right to:

  • Know/Access categories/specific pieces of personal information collected,

  • Delete personal information,

  • Correct inaccurate personal information,

  • Opt out of “sharing” for cross-context behavioral advertising,

  • Limit use/disclosure of sensitive personal information (to what’s necessary to provide requested services),

  • Non-discrimination for exercising rights.

Opt-out of sharing/targeted ads: email us or use available cookie controls/GPC.

Nevada (NRS 603A) – If Applicable

Nevada residents may request that we not sell (as defined by Nevada law) certain personal information. We do not sell personal information as defined by Nevada law, but you may still submit a request at [email protected] with “Nevada Do Not Sell.”

Other U.S. State Rights (e.g., CO, CT, VA, UT) – If Applicable

Residents of some states have rights to access, correct, delete, and opt out of targeted advertising and certain profiling. Submit requests to [email protected]. If we deny a request, you may have the right to appeal by replying “Appeal” to our decision email.

EU/UK Residents – If Applicable

Where the EU/UK GDPR applies, our legal bases include performance of a contract, legitimate interests, legal obligations, and consent (e.g., for certain marketing/cookies). You may have rights to access, rectify, erase, restrict, portability, object, and to withdraw consent. You may also complain to your local supervisory authority.


11) Sensitive & Wellness Information

If you choose to share wellness/fitness data (e.g., measurements, progress photos, health history relevant to training), we use it to personalize coaching and provide the Services. Do not submit information you are not comfortable sharing. You can request deletion (subject to legal exceptions).


12) Notice of Financial Incentives (California)

From time to time, we may offer referral rewards, discounts, or similar programs that could be considered “financial incentives” under the CPRA. Participation is voluntary and requires opt-in (e.g., by submitting a form). You may withdraw at any time by contacting us.

  • Categories of personal information involved: contact details and program engagement data.

  • Value of the incentive: varies by program (e.g., a promotional credit or referral bonus).

  • We reasonably estimate the value based on the benefit to us from increased engagement/sales and related expenses.


13) Third-Party Links & Services

Our Services may link to third-party sites/apps. Their privacy practices are governed by their own policies. We are not responsible for third-party content or privacy practices.


14) International Data Transfers

If you access the Services from outside the United States, your information may be transferred to and processed in the U.S. and other countries that may have different data protection laws than your country of residence.


15) Dispute Resolution & Arbitration

Your use of the Services is also subject to our Terms & Conditions (including binding arbitration in Clark County, Nevada, class action and jury trial waivers, and time limits for claims). Please review the Terms for details.


16) Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will change the “Effective Date” above and, where required, notify you. Your continued use of the Services after an update means you accept the revised Policy.
